Modifications

Once custody, support and visitation have been established by a court, specific procedures are required to alter the arrangement. Mediation may be required before going to court. If that is unsuccessful, the parents must petition the court to make any modifications.

In order to support a request for a change to a custody or visitation arrangement, the petitioning parent must show a significant change in circumstances. However, all courts will consider a request for modification if it can be demonstrated that the child is endangered by the current custody arrangement.

A family law attorney will be able to best present your petition to the court and provide legal advice on the best course of action to modify an existing agreement. Jim Knappenberger has more than 40 years of experience in the Family Courts and can help explain the modification process to you.
